Minnesota radon requirements for new construction

MN Rules 1303.2400-1303.2403In force since June 1, 2009

What your permit set must show

  • Passive sub-slab depressurization rough-in required in all new residential buildings statewide.
  • Gas-permeable layer below slab to allow air movement to the pipe.
  • Soil gas retarder (vapor barrier) over the gas-permeable layer.
  • Vent pipe routed from below slab to exterior, sized and positioned per MN Rules 1303.2400-1303.2403.
  • Active fan added post-occupancy only if radon testing exceeds the action level.

Common questions

Does every new Minnesota home need a radon system?

Yes. Minnesota Rules 1303.2400-1303.2403 require a passive radon mitigation system in all new residential buildings statewide. Minnesota adopted IRC Appendix F from the 2006 IRC as a mandatory requirement in June 2009, making it one of the first states to do so.

Is a powered fan required at construction?

No. The passive rough-in is required at construction. An active fan is added after occupancy only if testing shows radon levels at or above the action level. The passive system is designed so a fan can be added later without major renovation.

What does the plans examiner look for?

Reviewers check for a gas-permeable layer and vapor barrier below the slab, a vent pipe shown with correct sizing and routing, and an exterior termination point. Minnesota is EPA Zone 1 across most of the state, so plan reviewers treat radon rough-in details as a standard checklist item.

Do I need a radon license to install this during new construction?

No. Minnesota law explicitly exempts the installation of radon control systems in newly constructed homes prior to a certificate of occupancy from the state's professional licensure requirement. This exemption makes new construction the clearest safe-harbor category under Minnesota radon law.
